General Terms of Sale

These General Terms of Sale govern the sales of products offered on the Swellcraft website. Any order placed on the site implies full acceptance of these terms. This translation is provided for information; in case of discrepancy, the French version prevails.

1. Products

Swellcraft offers accessories designed and handmade, notably using 3D printing. Products are presented with the greatest care to give accurate information about their features, dimensions and use.

Due to the 3D printing process, slight variations in colour, texture or finish may appear from one product to another. These variations are not a manufacturing defect.

2. Prices

Product prices are shown in euros and are those displayed on the site at the time of ordering. VAT not applicable, art. 293 B of the French Tax Code (CGI).

Any shipping costs are shown to the customer before the order is finally confirmed.

Swellcraft reserves the right to change its prices at any time. However, the price applied to an order is the one displayed when it is confirmed.

3. Order

The customer can select the products they wish to buy and add them to their cart. Before finalising the order, they can check and change the information entered.

The order becomes final once payment is confirmed.

An order confirmation may be sent by email to the address given by the customer.

4. Manufacturing and order preparation

As Swellcraft products are handmade, a preparation time may be needed before shipping.

Each product is checked and prepared with care before dispatch.

The preparation time is shown on the site when necessary. In the event of an exceptional delay, the customer can contact Swellcraft for information about their order.

5. Delivery

Orders are shipped to the address given by the customer when ordering.

Delivery times depend on the carrier and the delivery method chosen. Times announced by the carrier may vary and do not guarantee delivery on a specific date, unless the law provides otherwise.

Swellcraft cannot be held responsible for delays, losses or incidents attributable to the carrier, subject to the legal obligations applicable to the seller.

6. Payment

Payment is made online at the time of ordering by bank card and other methods offered on the secure payment page of our provider Stripe. Swellcraft never has access to your bank details.

The order is prepared after payment is confirmed.

7. Right of withdrawal

In accordance with applicable regulations, consumers have a legal period of fourteen days from receipt of the product to exercise their right of withdrawal, without having to justify their decision.

However, the right of withdrawal does not apply to certain products, in particular goods made to the consumer's specifications or clearly personalised.

Where the right of withdrawal applies, products must be returned in accordance with the terms set out in Swellcraft's return policy.

8. Legal guarantees

Products sold by Swellcraft benefit from the legal guarantees provided by French law, in particular the legal guarantee of conformity and the legal guarantee against hidden defects.

These guarantees give the customer the rights provided by law when the conditions of application are met.

9. Use of the products

Products must be used for their intended purpose and in accordance with any instructions provided with them.

Swellcraft cannot be held responsible for damage resulting from inappropriate or dangerous use, or use contrary to the instructions provided with the product.

Any modification of the product made by the customer is their own responsibility.

10. Intellectual property

The texts, photographs, logos, graphics, models and other content on the Swellcraft site are protected by intellectual property provisions.

Any reproduction, copying, modification or commercial use of these elements without prior authorisation is prohibited.

11. Personal data

Personal data collected during an order is used in particular to process the order, the payment, and the preparation and delivery of the products.

Personal data is processed in accordance with the applicable data protection regulations.

Information about the processing of personal data is available in the site's privacy policy.

12. Customer service

For any question about an order, a product or these General Terms of Sale, the customer can contact Swellcraft using the contact details shown on the site.

13. Dispute resolution

In the event of a difficulty or dispute, the customer is invited to contact Swellcraft first to seek an amicable solution.

In accordance with Articles L. 611-1 et seq. of the French Consumer Code, consumers have the right to use a consumer mediator free of charge to settle a dispute with a trader amicably. Swellcraft has joined the mediation scheme of Société Médiation Professionnelle. If a written complaint to Swellcraft has not been satisfactorily resolved, you may refer the matter to the mediator online at www.mediateur-consommation-smp.fr, by e-mail to [email protected] or by post: Société Médiation Professionnelle, Alteritae, 5 rue Salvaing, 12000 Rodez, France.

These General Terms of Sale are governed by French law.

14. Acceptance of the General Terms of Sale

Confirming an order means that the customer acknowledges having read and accepted these General Terms of Sale before the sale is concluded.
